General Terms and Conditions for Bring Express Norge AS
Responsibility
The Customer is responsible for ensuring that the goods are packed properly. The Customer is responsible for entering the correct weight and dimensions in the transport documents. The Supplier reserves the right to check, and in the event of errors, correct the weight and dimensions that form the basis for calculating the price of the service. If the Customer is not fulfilling a significant part of his/her obligations or it appears from the way in which the Customer is acting—or due to a serious failure in creditworthiness—that the Customer is not going to fulfil a significant part of his/her obligations, the Supplier may check the level of compliance and withhold payment if the Customer is warned about this without undue delay. If one party significantly breaches their obligations under the agreement and does not rectify the situation following prior written warning from the other party, the party that is not in breach of its obligations can revoke the agreement. The Supplier is never responsible for covering the Customer’s indirect losses.
Prices
All prices are stated in NOK and exclude VAT. All prices are adjusted in line with Bring Express' general price regulations. We reserve the right to make changes to our prices as a result of regulations imposed by the subcontractor and the authorities.
Addition to agreed prices
Unless agreed otherwise, the prices do not include insurance, fees for veterinary checks and expenses, import VAT, public duties or currency and fuel surcharges. Services that are not included in the agreement are priced according to current charges. The prices do not include statutory government taxes, etc. The Supplier reserves the right to charge the Customer for extraordinary costs over which the Supplier has no influence from the time at which such costs are accrued. Examples of such costs may include (but are not limited to) diversions due to road works, ferry stoppages, train stoppages, force majeure or similar.
Force Majeure
If an extraordinary situation (force majeure) arises, which neither of the parties could reasonably have predicted on entering into the agreement or that arises outside of the parties’ control during the agreement period and that prevents fulfilment of this agreement, the affected party is exempt from his obligations and responsibilities in relation to this agreement for the length of time the extraordinary situation persists.
An extraordinary situation (force majeure) is considered to be mobilisation, war, civil war, vandalism, sabotage, strikes, lockouts, legal or illegal blockades, earthquakes, floods, landslides, hurricanes or other natural disasters, fires, explosions, embargoes, import and/or export restrictions, lack of oil or electricity, theft, robbery, criminal damage, a collision/traffic accident (where the driver is not at fault), a general traffic ban or restrictions imposed by public authorities in connection with, for example, accidents or suspicion of terrorism, or other unforeseen incidents beyond the control of the parties to this agreement or the parties’ subcontractors. Each of the parties bears their own costs in connection with force majeure.
Prohibited contents
The agreement only includes dangerous goods (including corrosive, toxic, explosive, flammable and hazardous substances, cf. substances) if this has been expressly agreed between the parties and under special conditions. Where the parties have agreed that dangerous goods shall be covered by the order, both parties shall fulfil their obligations in accordance with the prevailing International Maritime Dangerous Goods (IMDG) Code and/or the European Agreement Concerning the International Carriage of Dangerous Goods by Road (ADR) regulations. Unless otherwise agreed, goods cannot contain valuables, weapons, ammunition, live animals, human remains, or cigarettes/tobacco products.
The customer is responsible for ensuring that the goods can be legally transported in accordance with international conventions or legislation in the country to or from which the goods are being transported.
